IR35
This is a term used for a complex piece of anti-avoidance legislation introduced in 1999 that applies when a freelance worker provides services through an “intermediary”, normally a limited company, to carry out their business. The legislation seeks to look through the intermediary and establish whether the engagement between the individual and the end client would be regarded as employment or self-employment if the intermediary did not exist.
If an engagement is found to fall within the IR35 provisions, the fees received for that engagement are treated as employment income and are therefore subject to PAYE tax and National Insurance. Under the off-payroll working rules, responsibility for determining whether IR35 applies may fall on the end client or agency in certain circumstances, particularly in the public sector and for medium and large businesses in the private sector.
Determining the precise status of a particular engagement can be difficult and both the working practices and the relevant contracts will need to be reviewed in detail.
